Implementation of Mediation in Non-Muslim Family Dispute Resolution in Malaysia
Main Article Content
Abstract
In the litigation arena, among the majority of cases tried in court, mediation is arguably one of the most effective alternative methods in resolving disputes among non-Muslim families in Malaysia. In contrast to the adversarial litigation process, mediation is an informal, flexible, and voluntary alternative dispute resolution method that focuses more on the needs and interests of the parties involved. However, mediation is still rarely utilised by the affected parties due to the lack of a robust framework and procedures that have resulted in mediation failing to achieve its objective as an effective alternative dispute resolution method in the case of non-Muslim family disputes in Malaysia. This study provides an overview of the need for effective frameworks and governance in order for mediation to achieve its potential success rate in resolving non-Muslim family disputes in Malaysia. This study uses a qualitative method that focuses on doctrinal research in parallel with library-based research through the analysis of selected materials, including journals, articles and textbooks. The results of this study are expected to provide an approach in terms of improving effective frameworks and administration to maximise the potential of mediation as an alternative method in resolving non-Muslim family disputes in Malaysia.
